The following terminology is applicable to these Terms and Conditions, Privacy Statement, and Disclaimer Notice, as well as all Agreements: "Client," "You," and "Your" pertain to the individual logging onto this website or engaging in studies at LAPT-accredited/approved centers, adhering to the Company’s terms and conditions. "The Company," "Ourselves," "We," "Our," and "Us" refer to our Company. "Party," "Parties," or "Us" refer to both the Client and ourselves. All terms are indicative of the offer, acceptance, and consideration of payment necessary to undertake the process of our assistance to the Client, tailored to meet the Client’s needs in respect of the provision of the Company’s stated services, subject to the prevailing laws of the Netherlands. Any use of the above terminology or other words in the singular, plural, capitalized, and/or he/she or they, are deemed interchangeable and therefore refer to the same.

    If you are logged into the LAPT website or have studied at an LAPT Accredited Training Provider, you have agreed to abide by the information, terms, and conditions outlined on this page. These terms are applicable to all users, including:

    - Country/State/City Franchise of LAPT
    - Affiliates

    LAPT Certified Trainer

    Take a moment to review the terms for LAPT Certified Trainers. To become a trainer for courses listed on the LAPT website, apply and, upon approval, register students and publish your training schedule under your approved course.

    Upon approval, you'll gain access to a trainer's dashboard to manage your assigned training courses. This includes tracking your learners, checking assignments, assessing them, and overseeing your training delivery.

    Training Schedule

    Your training schedule will be visible under your profile, allowing you to publish schedules for courses you are certified to train. Schedule options include:

    1. Online Training for global online learners
    2. Onsite training for local learners
    3. E-Learning Schedule – Training videos of your previous classes

    LAPT Qualifications

    LAPT provides training courses (ILT, VILT, and E-Learning) and grants industry-recognized employable certifications based on proctored assessments and examinations. On-site and remote proctoring are managed by the LAPT team. Hospitality exams are also available at Pearson VUE testing centres in 180 countries.

    LAPT Accredited Online E-Learning (Video) Courses

    As a certified trainer, you can publish video-based E-learning courses. LAPT accredits online video-based training, and your learners can earn certification through the accreditation process.

    If you are a subject matter expert with professional work experience, accredit your courses with LAPT. Read "Course Accreditation and Qualification Development" for details and submit your course details, including assessment methods. This enables your learners to receive LAPT certification, following a structured framework with standard learning outcomes and reliable assessment procedures.

    Level of Accreditation

    Courses are accredited at different levels based on structure, duration, framework, learning outcomes, and assessments:

    1. Certificate Level
    2. Advanced Certificate Level
    3. Diploma Level
    4. Advanced Diploma Level/Post-Graduate Diploma Level

    Working professionals and trainers are invited to accredit their courses with LAPT, turning professional expertise into certification. Certificates are jointly awarded and contribute to the LAPT network of accredited training academies.

    Requirements

    To apply for LAPT Accreditation:

    1. Be a subject matter expert in your industry
    2. Offer courses with a clear career progression and route
    3. Provide certified learners with career guidance for industry placement

    Application is open to:

    1. Single applicants
    2. Teams of professionals
    3. Training academies
    4. Software or IT development companies
    5. Businesses establishing a global qualification framework

    Accreditation Procedure

    1. Submission: Provide a course description, industry details, and applicant profile (team, academy, company, etc.).

    2. Agreement: Upon agreement to provide accreditation services, we'll send a written confirmation along with a non-disclosure agreement (NDA).

    3. Documentation: Sign the NDA, and receive the accreditation and validation service agreement with financial terms.

    4. Course Details: The training provider submits the course syllabus, teaching methodology, training content resources, and exam model.

    5. Evaluation: The LAPT Technical Committee conducts an audit and assessment of the course.

    6. Approval: Upon approval by LACE Board members, LAPT recognizes and approves the course provided by the training provider.

    7. Certification: The certified course is listed under LAPT Academies, allowing delivery through LAPT Certified Trainers and academies.

    Assessments

    1. Examination: If skills can be assessed by a multiple-choice/written quiz, learners must achieve the minimum required marks.

    2. Assessments: Video-based or live online assessments are conducted for skills not measurable through multiple choice/written questions.

    Levels

    Learners receive the following qualifications based on course duration and assessments:

    - Certificate Level: Up to 30 hours duration
    - Advanced Certificate Level: Above 30 to 60 hours
    - Diploma Level: Above 60 to 100 hours
    - Advanced Diploma Level: Above 100 Hours

    Minimum Qualification Requirements

    1. No minimum qualification requirement for certificate and advanced certificate.
    2. Minimum 10th grade for Diploma Level Courses.
    3. Minimum 12th Grade for Advanced Diploma Courses.

    Terms for Training Providers

    The terms "training provider," "instructor," "teacher," and "LAPT Certified trainer" are interchangeable.

    Accessing the system as a training provider implies adherence to the following terms. LAPT reserves the right to modify, edit, remove, or add content to these terms and conditions.

    By logging in, you implicitly agree to all terms and conditions outlined on this page.

    Instructors' agreements are individualized with the company, regardless of any payment facilitation by any LAPT subdivision.

    As an instructor, you engage directly with LAPT LTD (a company incorporated in England and Wales with company number 04984798) on a freelance basis. Your engagement may be on an hourly basis or a revenue-sharing model, as specified in the training providers' terms. The Training Provider account functions as a seller's account, enabling you to offer and sell your training services. You can also publish and sell your content following the terms, guidelines, and policies outlined on this page (Side Panel).

    Your Responsibilities as a LAPT Certified Trainer

    Instructors bear full responsibility for any content they post on the platform ("submitted content").

    Instructors affirm the following:

    - The account information is accurate.
    - They are fully authorized to permit LAPT to use their content as per this document.
    - Submitted documents do not infringe on copyrights.
    - They are legally qualified and authorized to provide the services they post.
    - They guarantee work of quality that aligns with established standards.

    Instructors also commit to the following:

    - Keeping posts free from defamatory, racially discriminating, despicable, intransigent, obscene, or false content.
    - Avoiding the sharing of unauthorized materials on the platform.
    - Using the platform only for its intended purpose.
    - Not engaging in activities requiring unintended duties from LAPT.
    - Not obstructing or hindering other instructors' service offerings.
    - Not misappropriating the company's resources.
    - Not impersonating other instructors or accessing their accounts without permission.

    Authorization

    The instructor grants the company permission, as per the terms of service, to modify, market, and deliver the submitted content to students at its discretion.

    Instructors have the right to detach their entire or partial submitted content under normal circumstances, including adherence to the company's promotion policy.

    Instructors provide full permission for the company to use parts or the entirety of their submitted content for any purpose that enhances service delivery to clients. The company may also utilize personal information, including photos, voice, or name, provided it aligns with governing authorities' allowances.

    3. Trust and Safety

    3.1 Trust and Safety Policies

    Instructors must adhere to LAPT's standard Trust and Safety policies, including restricted topic policies within the training industry. Service access on the platform is subject to the company's approval. The company reserves the authority to prohibit an instructor, remove their work, or delay payments under the following circumstances:

    - A course fails to meet LAPT's required standards.
    - An instructor poses a threat to the company's reputation.
    - An instructor engages in illegal cooperation with a third party not aligned with LAPTS policies.
    - As determined by the company in its discretion.

    3.2 Relationships to Other Users

    A training provider interacts with students exclusively through the LAPTs platform. Therefore, any personal information about a student accessible to an instructor through LAPT should be used solely for the intended purposes. The instructor is fully responsible for any inappropriate use of a student's personal information.

    3.3 Anti-Piracy Efforts

    The company and its anti-piracy partners primarily protect an instructor's account and courses against unauthorized access. Enforcement required to safeguard the instructor's intellectual property will be carried out by the company and its specified partners.

    The company will uphold the above authorization unless the instructor revokes it by emailing the company's mailbox (piracy@LAPT.com) with the subject precisely phrased as "Revoke Anti-Privacy Protection Rights." The provided email information will be implemented within 48 hours.

    4. Pricing

    4.1 Price Setting

    Instructors are provided with a "base price" to select for their courses.

    4.2 Applicable Taxes

    The company collects and remits taxes to relevant authorities or transaction costs when a student purchases an instructor's products and services.

    5. Earnings

    5.1 Payment Division

    After a student makes a course purchase, the "gross amount" undergoes deductions before the tutor's net pay, the "net amount," is awarded to the instructor. Deductions include any applicable transaction taxes.

    - An instructor account receives a 50% post-deductions share of the net pay for learners registered through LAPT's advertising and promotion.
    - An instructor account receives a 70% to 90% post-deductions share of the net pay for learners registered by a training provider through student registration vouchers.

    Any changes to this payment rate will be communicated to the instructor via email or notice. Instructors with promotional programs accounts may have a different payment rate.

    Tutor payments are made in GBP or U.S. Dollars. The company covers processing costs, while the instructor is responsible for currency conversion fees needed in wiring.

    5.2 Receiving Payments

    Instructors receive payments through PayPal accounts, requiring tax details and a valid email account. The company reserves the right to deny payment if the instructor fails to provide the required information.

    Instructors are responsible for any taxes on their income, with payments issued within a maximum period of 45 days from the end of the month the company receives remittances. In cases of fraud or law violation, LAPT has the right to deny payments.

    Undelivered payments will be forwarded to the instructor's government according to the company's legal obligation.

    5.3 Refunds

    Students have the right to refunds, and no payment is given to an instructor if a client is refunded.

    LAPT has the authority to obtain money from the instructor if a student requires a refund after payment has been made. This can be achieved by deducting it from the next amount owed to the instructor or requesting the instructor to reverse the payment.

    6. Trademarks

    Adherence to the following specifications ensures that a published instructor has access to the utilization of trademarks:

    - Use the trademarks in accordance with the company's laws.
    - Only use the trademarks for marketing your course.
    - Cease the use of trademarks immediately when prompted to do so by the company.

    An instructor should not:

    - Use the trademark to mislead.
    - Use the trademark to portray receiving support from the company.
    - Use the trademark in a way that dishonors the laws of their country.

    7. Sanctions

    An instructor confirms that they are not subject to any international export and sanction restrictions, whether as an individual or representing an organization. In the event of being subject to these international restrictions while working with LAPT, the instructor must notify the company within 24 hours.

    8. Account Removal

    Training Providers can request account removal by sending an email to the web admin at info@lapt.org. When an instructor deletes an active account, submitted content remains accessible to students using the account before deletion. Additionally, any outstanding payments will be processed before the account is deleted. Difficulties encountered during the account deletion process can be addressed through the company's chat support.

    Accounts are deactivated but not fully removed as courses and learner records are associated with the training provider's name.

    9. Various Lawful Terms

    9.1 Reviewing

    LAPT periodically reviews its terms of service. Instructors receive notifications of updates via the provided email or notices on the platform. Working with the company after a revision implies agreement with the new terms.

    9.2 Correlation

    An instructor and the company share no relationship beyond the student-instructor interface.

    9.3 Extension

    The sections below in this document remain unaffected by the expiration of these terms.

    10. No Academic Credit

    LAPT certifications are developed by working professionals and subject matter experts, approved by the LAPT internal assessors board members. Certifications are awarded based on the assessment procedure mentioned under each certification, and a course completion certificate is awarded upon completing the course.

    Participation or completion of Content Offerings does not confer any academic credit. Learners agree not to accept credit for completing a Content Offering. LAPT instructors, accredited Training Academies, Corporate Clients, and Content Providers have no obligation to have Content Offerings recognized by any educational institution or accreditation organization.

    11. Certificate Disclaimer

    LAPT LTD issues certificates based on its own assessment and evaluation processes. These certificates are designed to recognize the professional skills based on our assessments in association with training providers globally

    Please be advised that our certificates may not fall into standard categories recognized by certain credential evaluation agencies, and they might not be universally accepted by all educational institutions, employers, or government bodies.

    Our certificates are not equivalent to degrees granted by accredited higher education institutions, and they do not confer academic credit. They are intended to represent the successful completion of training or courses provided by [Your Company/Institution Name].

    Recipients of our certificates are encouraged to verify with relevant institutions or employers whether our certificates meet their specific requirements. While many organizations may recognize and value the skills and knowledge gained through our programs, certificate holders need to understand that recognition may vary.

    We recommend that individuals seeking further education, employment, or professional certification inquire directly with the relevant authorities or institutions about the recognition and acceptance of certificates issued by LAPT LTD

    By accepting and utilizing the certificates issued by LAPT, the certificate holder acknowledges and understands the nature and scope of our certificates.

    LAPT LTD reserves the right to update, modify, or discontinue its certificate programs without prior notice.

    12. User Content

    The Services enable users to share content, such as homework, quizzes, exams, projects, and other assignments ("User Content"). Users retain all intellectual property rights and are responsible for User Content. LAPT is granted a license to use User Content, including the right to authorize Content Providers to use it with their students.

    LAPT reserves the right to remove or modify User Content for any reason, including violations of these Terms or other policies.
